← Simon Turner VS BHP: A better Outcome for All

"In order to be endorsed, an enterprise agreement must first pass the Fair Work Commission's better off overall test (the BOOT). Simon Turner has always argued that in his case this test could not possibly have been satisfied. He's right.

Evidence from the Fair Work Commission itself has recently emerged, proving this test was never applied to the enterprise agreement, stealing from Mr Turner and hundreds of casual coal miners employed at BHP's Mount Arthur mine in the Hunter Valley." Senator Malcom Roberts.

Question:

The CFMEU and the fair work commission should publicly explain how & why the BOOT test was not applied to the enterprise agreement?
