Should a formal constitutional process be initiated to assess whether the President is able to discharge the duties of office
Preamble
The 25th Amendment to the United States Constitution provides a mechanism to address situations where a sitting President may be unable to discharge the powers and duties of the office.
Under Section 4, the Vice President, together with a majority of the Cabinet, can initiate a formal process that may result in the temporary transfer of presidential authority, subject to review by Congress.
Following recent public statements by President Donald Trump regarding Iran, some legal analysts and commentators have raised questions about whether this constitutional safeguard should be considered.
Historically, invoking the 25th Amendment has been extremely rare. The threshold is high, and the political consequences are significant. As a result, the process has never been used in circumstances involving contested judgment or conduct.
This raises a broader question:
When concerns reach the level of public debate, should a formal process of constitutional assessment be initiated?
