Terms and Conditions of PByT Service
Effective Date: January 1, 2026
PByT is an online platform that enables individuals, organisations and communities to participate in structured public feedback, build trusted relationships, and access services designed to improve decision-making, accountability and civic participation.
These Terms and Conditions ("Terms") govern your access to and use of the PByT platform, including our website, memberships, subscriptions, feedback services, revenue sharing programs, applications and any other products or services we make available (collectively, the "Platform").
By creating an account, purchasing a membership, subscribing to a service or otherwise accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Platform.
These Terms form a legally binding agreement between you and the operator of the PByT platform ("PByT", "we", "our" or "us"). The current legal operator is identified in the Contact Information section of these Terms.
PByT is an evolving platform. We may introduce new services, modify existing features, improve our technology, or discontinue aspects of the Platform as it develops. We may also update these Terms from time to time to reflect changes in our services, legal obligations or business operations. Where practicable, we will provide reasonable notice of material changes before they take effect.
Your continued use of the Platform after updated Terms become effective constitutes your acceptance of those revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Platform.

2. Eligibility
To use the PByT Platform, you must meet the following eligibility requirements:
2.1 Minimum Age
You must be at least 18 years of age, or the age of legal majority in your jurisdiction if higher, to create an account or enter into these Terms.
If you are under the required age, you may only use the Platform where expressly permitted and under the supervision of a parent, guardian or other legally authorised representative.
2.2 Legal Capacity
By creating an account or using the Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement under the laws applicable in your jurisdiction.
2.3 Accurate Information
You agree to provide information that is accurate, current and complete when registering for an account or using the Platform. You are responsible for keeping your account information up to date.
Providing false, misleading or fraudulent information may result in the suspension or termination of your account.
2.4 Identity Verification
Certain features of the Platform, including participation in revenue sharing programs, premium services or other activities requiring verification, may require you to verify your identity.
PByT reserves the right to determine the methods of identity verification used and may change those methods from time to time to improve security, comply with legal obligations or reduce fraud.
Failure to complete required verification may limit access to certain features or result in the suspension of your account.
2.5 One Account Per Individual
Unless expressly authorised by PByT, each individual may maintain only one personal account.
Creating or operating multiple accounts for the purpose of manipulating feedback, circumventing Platform rules, obtaining additional benefits or engaging in fraudulent activity is prohibited.
Separate business, organisational or administrative accounts may be permitted where authorised by PByT.
2.6 Compliance with Laws
You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction.
PByT does not represent that the Platform or any of its services are lawful or available in every country or territory. Access to the Platform from locations where its use is prohibited is undertaken at your own risk.
2.7 Acceptance of Platform Rules
By using the Platform, you agree to comply with these Terms, our Privacy Policy, Community Standards and any additional policies or program rules that apply to specific features or services made available through PByT.
3. Member Accounts
3.1 Account Registration
To access certain features of the Platform, you must create a PByT account.
When registering, you agree to provide accurate, complete and current information and to keep that information up to date. You are responsible for ensuring that the information associated with your account remains accurate.
PByT reserves the right to refuse, suspend or terminate any account that contains false, misleading or incomplete information.
3.2 Account Security
You are responsible for maintaining the confidentiality of your password and any other credentials used to access your account.
You are also responsible for all activities that occur under your account, whether authorised by you or not, unless those activities result directly from our failure to maintain appropriate security.
If you believe your account has been accessed without your authorisation or your login credentials have been compromised, you must notify PByT as soon as reasonably practicable.
3.3 Personal Responsibility
You are responsible for all content you publish, feedback you submit, comments you make and activities undertaken through your account.
You agree not to allow another person to use your account or impersonate another individual or organisation through the Platform.
3.4 Keeping Your Account Current
You agree to promptly update your contact details and any other information required to administer your account.
Where identity verification or other information becomes outdated or cannot be verified, PByT may request updated information before allowing continued access to certain features of the Platform.
3.5 Account Suspension
PByT may temporarily suspend access to your account where reasonably necessary, including where:
- we believe your account has been compromised;
- we suspect fraudulent, deceptive or unlawful activity;
- you breach these Terms or any applicable Platform policies;
- your account presents a security risk to the Platform or other members; or
- we are required to do so by law.
Where appropriate, we will endeavour to notify you of the reason for the suspension and provide an opportunity to resolve the issue.
3.6 Closing Your Account
You may close your account at any time by following the account closure process provided through the Platform or by contacting PByT.
Closing your account does not automatically cancel any active subscription or other payment obligation unless those services are separately cancelled in accordance with their applicable terms.
Certain information may be retained after account closure where required by law, for fraud prevention, to resolve disputes, to enforce these Terms, or as described in our Privacy Policy.
3.7 Account Availability
While we endeavour to provide continuous access to the Platform, we do not guarantee that your account or any Platform feature will always be available.
Access may be interrupted for maintenance, upgrades, security measures, technical issues or circumstances beyond our reasonable control.
4. Memberships and Subscriptions
4.1 Membership Options
PByT may offer a range of membership plans and subscription services, including free and paid memberships, together with additional services or benefits that may be introduced from time to time.
The features, benefits, eligibility requirements and pricing of each membership plan are described on the Platform and may be amended in accordance with these Terms.
4.2 Paid Memberships
Certain features of the Platform are available only to members who maintain an active paid subscription.
By purchasing a paid membership, you agree to pay the applicable subscription fees and any taxes or charges that may apply.
Access to paid features continues only while your subscription remains active and your account complies with these Terms.
4.3 Subscription Renewals
Unless otherwise stated at the time of purchase, paid subscriptions renew automatically at the end of each billing period.
You authorise PByT to charge the applicable subscription fee using your nominated payment method until your subscription is cancelled.
You may cancel your subscription at any time. Cancellation will prevent future renewals but will not normally result in a refund for the current billing period, except where required by applicable law.
4.4 Changes to Memberships
PByT may introduce new membership plans, modify existing memberships, adjust pricing, or discontinue membership options as the Platform evolves.
Where practicable, reasonable notice will be provided before material changes affecting existing paid memberships take effect.
Continued use of the relevant membership after those changes become effective constitutes acceptance of the updated membership terms.
4.5 Payment Processing
Payments for subscriptions and other paid services may be processed through one or more third-party payment providers.
By making a payment, you also agree to comply with the terms and conditions of the relevant payment provider.
PByT does not store complete payment card details and is not responsible for the operation, availability or security of third-party payment services.
4.6 Failed Payments
If a subscription payment cannot be processed, PByT may suspend or restrict access to paid features until payment has been successfully received.
We may retry failed payments using the payment method you have authorised, subject to applicable law and the policies of the payment provider.
4.7 Refunds
Unless otherwise required by law or expressly stated for a particular product or service, subscription fees and other payments are non-refundable.
Nothing in these Terms excludes or limits any rights or remedies available under applicable consumer protection laws.
4.8 Promotional Offers
From time to time, PByT may offer promotional pricing, introductory offers, free trials or other incentives.
Unless otherwise stated, promotional offers:
- are available for a limited time only;
- may be withdrawn or amended at any time;
- cannot be transferred, exchanged or redeemed for cash; and
- may be subject to additional eligibility requirements or conditions.
4.9 Future Services
PByT may introduce additional paid services, memberships, incentive programs or participation models in the future.
Unless expressly stated otherwise, those services will be governed by these Terms together with any additional program rules or conditions published by PByT.
5. Revenue Sharing Program
5.1 General
PByT may operate one or more Revenue Sharing Programs to encourage participation, recognise contributions to the Platform and reward eligible members.
Participation in any Revenue Sharing Program is voluntary and is subject to these Terms together with any additional program rules published by PByT.
5.2 Eligibility
Participation in a Revenue Sharing Program may require members to satisfy eligibility requirements determined by PByT, including but not limited to:
- maintaining an eligible membership;
- completing any required identity verification;
- complying with these Terms and Community Standards;
- maintaining accurate payment information; and
- satisfying any additional program requirements published by PByT.
Eligibility to participate does not guarantee that a member will receive revenue sharing payments.
5.3 Revenue Share Accounts
Where applicable, PByT may establish one or more Revenue Share Accounts to record allocations made under a Revenue Sharing Program.
The method by which allocations are earned, recorded, calculated or displayed is determined by PByT and may be modified from time to time.
Revenue Share Accounts are maintained solely for the purposes of administering the relevant program and do not constitute bank accounts, investment accounts or ownership interests in PByT.
5.4 Revenue Sharing Payments
Where a Revenue Sharing Program provides for payments to members, those payments will be made in accordance with the applicable program rules.
Payments may be subject to minimum payment thresholds, verification requirements, taxation obligations, payment processing requirements and any other conditions specified by PByT.
Members are responsible for providing accurate payment details and for complying with any tax obligations arising from payments received.
5.5 Program Changes
PByT may introduce, modify, suspend or discontinue any Revenue Sharing Program, including its eligibility requirements, allocation methods, payment calculations or program benefits.
Where practicable, reasonable notice will be provided before material changes affecting active participants take effect.
5.6 Suspension or Forfeiture
PByT may suspend participation in, withhold payments from, or cancel Revenue Share Accounts where it reasonably believes that a member has:
- breached these Terms;
- engaged in fraudulent or deceptive conduct;
- attempted to manipulate Platform activity or revenue allocations;
- provided false or misleading information;
- failed to satisfy ongoing eligibility requirements; or
- otherwise acted in a manner that undermines the integrity of the Platform or the Revenue Sharing Program.
5.7 No Guarantee of Earnings
Participation in a Revenue Sharing Program does not guarantee that a member will receive any payment or achieve any particular level of earnings.
Revenue sharing payments, where offered, depend on a range of factors including Platform activity, program rules, member participation and the financial performance of the relevant program.
Past payments or allocations do not guarantee future payments.
5.8 No Employment or Partnership
Participation in a Revenue Sharing Program does not create an employment relationship, partnership, joint venture, agency or fiduciary relationship between PByT and any member.
Members participate in Revenue Sharing Programs solely as independent users of the Platform.
6. User Content
6.1 Ownership of User Content
You retain ownership of the original content you submit, publish or upload to the Platform, including questions, articles, comments, images and other material ("User Content").
Nothing in these Terms transfers ownership of your User Content to PByT.
6.2 Licence Granted to PByT
By submitting User Content to the Platform, you grant PByT a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, publish, distribute, adapt, format and otherwise use your User Content to the extent reasonably necessary to operate, maintain, improve and promote the Platform.
This licence continues for as long as your User Content remains on the Platform and, where reasonably necessary, for a reasonable period thereafter to enable backup, archival, legal compliance and the administration of the Platform.
6.3 Feedback Analysis
You acknowledge that one of the purposes of the Platform is to collect, organise and analyse structured feedback.
By participating in the Platform, you grant PByT the right to analyse User Content and member feedback, produce aggregated statistics, generate reports, identify trends and publish summaries, provided that personal information is handled in accordance with our Privacy Policy.
Unless expressly identified, published reports and analyses may combine feedback from multiple users and should not be interpreted as identifying the views of any individual participant.
6.4 Your Responsibilities
You are solely responsible for the User Content you publish.
You represent and warrant that:
- you own the User Content or have all necessary rights to publish it;
- your User Content does not infringe the intellectual property or other rights of any person;
- your User Content complies with these Terms and applicable laws; and
- the publication of your User Content does not violate any contractual or legal obligation owed to another person or organisation.
6.5 Removal of User Content
PByT may remove, restrict, edit or disable access to User Content where we reasonably believe that it:
- breaches these Terms or our Community Standards;
- infringes the rights of another person;
- is unlawful, misleading or fraudulent;
- presents a security or operational risk to the Platform; or
- is otherwise necessary to protect the integrity of the Platform or comply with legal obligations.
Where appropriate, we will endeavour to notify the affected member and provide an opportunity to address the issue.
6.6 Account Closure
If your account is closed, you may lose access to some or all of your User Content.
PByT may retain or remove User Content after account closure where reasonably necessary to preserve the integrity of public discussions, comply with legal obligations, resolve disputes, prevent fraud or maintain the operation of the Platform.
6.7 Feedback Results
You acknowledge that feedback submitted by members represents their opinions at the time it is provided.
Unless expressly stated otherwise, aggregated feedback, ratings, trust indicators and other Platform results are intended to assist users in making informed decisions and should not be interpreted as statements of objective fact or professional advice.
7. Feedback and Surveys
7.1 Purpose of the Platform
PByT provides a platform for individuals, organisations and communities to create questions, participate in structured feedback and engage in constructive public discussion.
The Platform is designed to facilitate the collection and analysis of opinions. PByT does not endorse or verify the accuracy of opinions expressed by members unless expressly stated.
7.2 Responsibility for Published Questions
Members who publish questions, surveys, articles or other discussion topics are responsible for the content they publish.
Authors should take reasonable care to ensure that questions are presented fairly, clearly and in a manner that encourages informed and constructive participation.
7.3 Prohibited Content
Questions, surveys, comments and other User Content must not:
- contain material that is unlawful, defamatory or fraudulent;
- deliberately misrepresent facts or impersonate another person or organisation;
- infringe the intellectual property or privacy rights of others;
- encourage violence, hatred or unlawful conduct;
- contain malicious software or harmful code; or
- otherwise breach these Terms or the Community Standards.
7.4 Participation in Feedback
Members are encouraged to participate honestly, respectfully and in good faith.
You agree not to manipulate feedback through multiple accounts, coordinated voting, automated systems or any other deceptive practice intended to distort Platform results.
7.5 Aggregated Results
PByT may compile, analyse and publish aggregated feedback, trends, statistical summaries and other reports based on member participation.
Unless expressly stated otherwise, published results represent the collective opinions of participating members and should not be interpreted as statements of objective fact or professional, legal, financial or medical advice.
7.6 Editorial Independence
The publication of a question, article, survey or other content on the Platform does not imply that PByT endorses, supports or agrees with the views expressed.
Authors remain responsible for their own content and opinions.
7.7 Moderation
To maintain the integrity of the Platform, PByT may review, moderate, restrict, edit or remove content that reasonably appears to breach these Terms, the Community Standards or applicable law.
Moderation may be carried out by authorised personnel, automated systems or a combination of both.
7.8 No Guarantee of Participation
PByT does not guarantee that any question, survey or discussion will receive responses, achieve a particular level of participation or produce any specific outcome.
The visibility and engagement of content may depend on factors including member interest, Platform features, moderation decisions and other operational considerations.
7.9 Constructive Participation
PByT is founded on the belief that better decisions are made when people are able to participate openly, honestly and respectfully in discussions that affect them.
While members are free to express differing opinions, they are encouraged to engage in good faith, support constructive dialogue, and contribute in ways that foster trust, mutual respect and informed decision-making.
PByT seeks to promote meaningful participation rather than division. Members are therefore encouraged to consider not only their right to express an opinion, but also their responsibility to contribute positively to the quality of public discussion.
8. Community Standards
8.1 Our Commitment
PByT seeks to provide a safe, respectful and trustworthy environment where individuals can participate in constructive public discussion and contribute to informed decision-making.
All members are expected to use the Platform responsibly and in a manner that respects the rights of others and supports the integrity of the Platform.
8.2 Respectful Conduct
When using the Platform, you agree to:
- treat other members with courtesy and respect;
- engage honestly and in good faith;
- respect differing opinions and viewpoints;
- avoid personal attacks, intimidation or harassment; and
- contribute in a manner that supports constructive discussion.
Disagreement is encouraged where expressed respectfully. Personal abuse is not.
8.3 Platform Integrity
You must not engage in conduct that interferes with the integrity or proper operation of the Platform.
Prohibited conduct includes, but is not limited to:
- creating or operating fake or multiple accounts without authorisation;
- impersonating another person or organisation;
- manipulating feedback, ratings or survey results;
- using automated systems, bots or scripts to influence Platform activity;
- purchasing, selling or artificially generating engagement;
- attempting to circumvent Platform rules or security measures; or
- assisting another person to engage in prohibited conduct.
8.4 Unlawful or Harmful Conduct
You must not use the Platform to:
- engage in unlawful activity;
- publish or distribute malicious software or harmful code;
- threaten, harass, stalk or abuse another person;
- promote violence or criminal activity;
- infringe another person's intellectual property or privacy rights; or
- interfere with the security or operation of the Platform.
8.5 Spam and Unsolicited Communications
You must not use the Platform to send spam, unsolicited commercial communications or repetitive content that disrupts normal Platform activity.
PByT may remove spam or promotional material and take action against accounts responsible for repeated or serious violations.
8.6 Enforcement
Where PByT reasonably believes that a member has breached these Community Standards, we may take appropriate action, including:
- issuing a warning;
- removing or restricting content;
- limiting access to particular Platform features;
- temporarily suspending an account;
- withholding participation in Platform programs;
- permanently terminating an account; or
- taking any other action reasonably necessary to protect the Platform, its members or our legal obligations.
The action taken will generally reflect the nature and seriousness of the breach.
8.7 Reporting Concerns
Members are encouraged to report suspected breaches of these Terms or the Community Standards through the reporting mechanisms provided by the Platform.
PByT will review reports in good faith but does not guarantee that every reported matter will result in action.
8.8 Continuous Improvement
As the Platform evolves, PByT may update these Community Standards to address emerging technologies, new forms of misuse and changing legal or community expectations.
Members are encouraged to help maintain a community founded on trust, accountability and respectful participation by acting responsibly and reporting conduct that undermines the integrity of the Platform.
9. Identity Verification
9.1 Purpose
Trust is fundamental to the operation of the PByT Platform.
To help protect members, maintain the integrity of structured feedback and reduce fraud, PByT may require members to verify their identity before accessing certain features or participating in specific programs.
9.2 Verification Requirements
Identity verification may be required for purposes including:
- creating or maintaining particular types of accounts;
- accessing Premium Memberships or other paid services;
- participating in Revenue Sharing Programs;
- receiving payments from PByT;
- protecting the Platform from fraud or misuse; or
- complying with applicable legal or regulatory requirements.
The verification requirements applicable to a particular service or program will be determined by PByT.
9.3 Verification Methods
PByT may use one or more methods to verify a member's identity, either directly or through authorised third-party verification providers.
Verification methods may be introduced, modified or replaced from time to time to improve security, accuracy, privacy or operational efficiency.
9.4 Member Responsibilities
Where identity verification is required, you agree to:
- provide accurate and truthful information;
- promptly provide any information reasonably requested to complete the verification process;
- notify PByT if your verified information changes in a material way; and
- refrain from using another person's identity or verification credentials.
Providing false, misleading or fraudulent information may result in the suspension or termination of your account.
9.5 Verification Status
Successful identity verification confirms only that PByT has taken reasonable steps to verify the identity associated with an account at the time of verification.
Verification should not be interpreted as an endorsement of a member's character, opinions, qualifications, reputation or future conduct.
9.6 Failure to Verify
If a member does not complete any required identity verification within a reasonable period, PByT may:
- restrict access to certain Platform features;
- suspend participation in Revenue Sharing Programs or other services;
- delay or withhold payments until verification is completed;
- suspend or terminate the relevant account; or
- take any other reasonable action necessary to protect the integrity of the Platform.
9.7 Privacy
Personal information collected during the identity verification process will be handled in accordance with the PByT Privacy Policy.
PByT will take reasonable steps to protect verification information and will only use or disclose it as permitted by law or as described in the Privacy Policy.
10. Privacy
10.1 Our Commitment to Privacy
PByT respects your privacy and is committed to protecting your personal information.
Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms and should be read together with them.
10.2 Information We Collect
PByT may collect information that you provide directly, information generated through your use of the Platform, and information necessary to administer memberships, subscriptions, payments, identity verification and other Platform services.
The types of information we collect are described in our Privacy Policy and may change as the Platform evolves.
10.3 Public Participation
The purpose of the Platform is to facilitate public participation.
Accordingly, information that you intentionally choose to publish—such as profile information, articles, questions, comments and other public contributions—may be visible to other members or the public, depending on your privacy settings and the nature of the content.
You are responsible for deciding what information you choose to publish through the Platform.
10.4 Personal Information
Personal information that is not intended for public display, including account information, identity verification information, payment information and other confidential data, will be handled in accordance with our Privacy Policy and applicable privacy laws.
PByT will take reasonable steps to protect such information from unauthorised access, use or disclosure.
10.5 Communications
By creating an account or subscribing to the Platform, you agree that PByT may send you communications relating to:
- your account;
- memberships and subscriptions;
- payments and billing;
- security or verification matters;
- important Platform updates; and
- changes to these Terms or our Privacy Policy.
Where required by law, you will be given the opportunity to opt in or opt out of marketing communications.
10.6 Cookies and Similar Technologies
PByT may use cookies and similar technologies to improve the operation, security and performance of the Platform, personalise your experience and better understand how members use our services.

10.7 International Use
PByT may use service providers located in different countries to assist in operating the Platform.
Where personal information is transferred internationally, PByT will take reasonable steps to ensure that appropriate safeguards are in place, consistent with applicable privacy laws.
10.8 Privacy Policy
Our Privacy Policy may be updated from time to time to reflect changes in our services, technology, legal obligations or business practices.
Your continued use of the Platform after the Privacy Policy has been updated constitutes acceptance of the revised Privacy Policy to the extent permitted by applicable law.
11. Intellectual Property
11.1 Ownership of the Platform
The PByT Platform, including its software, source code, databases, design, layout, graphics, logos, branding, text, audio, video, documentation and other materials made available by PByT, is owned by or licensed to PByT and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms, no part of the Platform may be copied, reproduced, modified, distributed, sold or otherwise exploited without the prior written permission of PByT.
11.2 Proprietary Systems and Methodologies
The concepts, methodologies, processes and systems developed by PByT for the collection, organisation, analysis and presentation of structured feedback, together with any associated trust indicators, reputation metrics, participation models, incentive programs, algorithms and decision-support tools, are proprietary to PByT unless otherwise stated.
Nothing in these Terms grants any member ownership of, or rights to reproduce, commercialise or create derivative works from those proprietary systems except as expressly authorised by PByT.
11.3 Trademarks
"PByT", "Powered by Trust", together with any associated logos, trade marks, service marks, badges and branding used on the Platform, are the property of PByT or its licensors.
You must not use, reproduce or display these marks in a manner that is likely to cause confusion or suggest sponsorship, endorsement or affiliation without prior written permission.
11.4 User Content
Ownership of User Content remains with the member who created it, subject to the licence granted to PByT under Section 6 of these Terms.
Nothing in this section limits the rights granted by members to PByT for the operation, promotion and improvement of the Platform.
11.5 Feedback Results and Platform Data
The organisation, presentation, aggregation, visualisation and analysis of feedback, together with Platform-generated statistics, trust indicators, reports and analytical outputs, form part of the intellectual property of PByT.
Members may use publicly available Platform results for personal, educational and non-commercial purposes, provided the source is appropriately acknowledged.
Commercial reproduction, systematic extraction or redistribution of Platform data without the prior written permission of PByT is prohibited.
11.6 Suggestions and Feedback
If you provide suggestions, ideas, recommendations or other feedback relating to the Platform or its services, you acknowledge that PByT may use, modify and incorporate those suggestions without obligation to compensate you or obtain further permission.
11.7 Copyright Infringement
PByT respects the intellectual property rights of others.
If you believe that content published on the Platform infringes your copyright or other intellectual property rights, you should notify PByT with sufficient information to enable us to investigate the matter.
Where appropriate, PByT may remove or disable access to allegedly infringing material while the matter is being reviewed.
11.8 Reservation of Rights
Except for the limited rights expressly granted under these Terms, all intellectual property rights in the Platform are reserved by PByT.
No licence or right is granted by implication, estoppel or otherwise.
12. AI and Automated Systems
12.1 Use of Automated Systems
PByT may use automated systems, including artificial intelligence ("AI"), machine learning and other technologies, to assist in the operation, security and improvement of the Platform.
These systems may support activities such as content moderation, spam detection, fraud prevention, identity verification, search, translation, recommendations, analytics, reporting and other Platform functions.
12.2 Purpose
The purpose of these technologies is to improve the quality, efficiency, security and integrity of the Platform and to assist members in participating more effectively.
Automated systems are intended to support, rather than replace, responsible Platform governance.
12.3 Accuracy
While PByT seeks to ensure that automated systems operate reliably, no automated technology is perfect.
Recommendations, classifications, summaries, translations, moderation decisions and other outputs generated or assisted by automated systems may contain errors or may not reflect every relevant circumstance.
Members should exercise their own judgement when relying on information generated or presented by the Platform.
12.4 Platform Improvements
PByT may use aggregated and de-identified Platform data to improve its automated systems, develop new Platform features and enhance the overall user experience.
Any use of personal information will be governed by the Privacy Policy and applicable privacy laws.
12.5 Human Oversight
Where appropriate, PByT may review or override the outputs of automated systems.
The level of human involvement may vary depending on the nature of the decision, the type of content involved, operational requirements and applicable legal obligations.
12.6 Evolving Technology
As technology continues to develop, PByT may introduce new automated systems, modify existing technologies or discontinue particular automated functions.
Such changes form part of the ongoing evolution of the Platform and do not require amendment of these Terms unless otherwise required by law.
12.7 Responsible Use
PByT is committed to developing and using automated systems responsibly and in a manner that supports the Platform's objectives of improving trust, informed participation and constructive public dialogue.
Members are expected to use AI-assisted features responsibly and must not use automated systems in a manner that manipulates Platform participation, deceives other members or otherwise undermines the integrity of the Platform.
13. Platform Availability and Changes
13.1 Availability
PByT aims to provide reliable access to the Platform and its services. However, we do not guarantee that the Platform will always be available, uninterrupted, secure or error-free.
From time to time, access may be interrupted or limited due to maintenance, upgrades, security measures, technical issues, network failures or circumstances beyond our reasonable control.
13.2 Maintenance and Updates
To maintain the security, stability and performance of the Platform, PByT may carry out scheduled or unscheduled maintenance.
Where practicable, we will endeavour to provide reasonable notice of planned maintenance that is likely to significantly affect Platform availability.
13.3 Platform Changes
PByT continually develops and improves the Platform.
Accordingly, we may introduce new features, modify existing functionality, suspend or discontinue services, or otherwise change how the Platform operates.
Where practicable, we will endeavour to provide reasonable notice of material changes that significantly affect members.
13.4 Experimental Features
From time to time, PByT may release trial, beta or experimental features to selected members or to the public.
Such features are provided for evaluation purposes and may be modified, suspended or withdrawn at any time without notice.
Experimental features may not operate as intended and are provided on an "as available" basis.
13.5 Third-Party Services
The Platform may rely on third-party providers for services including hosting, payment processing, identity verification, communications, analytics and other operational functions.
PByT is not responsible for interruptions, failures or delays caused by third-party services that are beyond our reasonable control.
13.6 Data Integrity
While PByT takes reasonable steps to protect Platform data, no electronic system can be guaranteed to be completely secure or free from data loss.
Members are encouraged to retain their own copies of important information that they publish or upload to the Platform.
13.7 Force Majeure
PByT will not be liable for any delay, interruption or failure to perform its obligations where such failure results from events beyond its reasonable control, including natural disasters, acts of government, war, terrorism, industrial disputes, widespread internet outages, cyber attacks or failures of third-party infrastructure.
13.8 Continuous Improvement
PByT is committed to continually improving the Platform in response to technological developments, member feedback, changing legal requirements and emerging community needs.
Not every improvement will be immediately available to all members, and the timing and implementation of new features will remain at the discretion of PByT.
13.9 Member Participation in Platform Development
PByT values the ideas, feedback and experience of its members and recognises that meaningful participation contributes to the ongoing improvement of the Platform.
Members are encouraged to provide suggestions for new features, services, policies and other improvements. PByT may consider such feedback in the development and evolution of the Platform.
While member participation is an important part of the Platform's continuous improvement, PByT retains sole responsibility and discretion for the design, development, operation and governance of the Platform, including decisions regarding which suggestions are adopted and how they are implemented.
14. Suspension and Termination
14.1 Suspension
PByT may temporarily suspend a member's account, or restrict access to particular features or services, where it reasonably believes that such action is necessary to:
- protect the security or integrity of the Platform;
- investigate suspected breaches of these Terms;
- prevent fraud, misuse or unlawful activity;
- comply with legal or regulatory obligations; or
- protect the rights, safety or legitimate interests of members or third parties.
Where appropriate, PByT will endeavour to notify the affected member of the reason for the suspension and, where reasonably practicable, provide an opportunity to resolve the matter.
14.2 Termination by the Member
You may terminate your account at any time by following the account closure process provided through the Platform or by contacting PByT.
Termination of your account does not automatically cancel any active subscription or other payment obligation unless those services are separately cancelled in accordance with their applicable terms.
14.3 Termination by PByT
PByT may terminate an account where a member:
- commits a serious or repeated breach of these Terms;
- engages in fraudulent, deceptive or unlawful conduct;
- deliberately manipulates Platform participation or feedback;
- repeatedly violates the Community Standards;
- provides false or misleading information;
- fails to complete required identity verification;
- uses the Platform in a manner that presents a significant risk to other members or the Platform; or
- otherwise acts in a manner that materially undermines the integrity or proper operation of the Platform.
Except where immediate action is reasonably necessary, PByT will endeavour to act proportionately and may issue warnings or provide an opportunity to remedy the breach before terminating an account.
14.4 Effect of Termination
Upon suspension or termination, PByT may:
- disable access to the affected account;
- remove or restrict access to User Content where appropriate;
- cancel or suspend memberships or subscriptions;
- suspend participation in Revenue Sharing Programs or other Platform initiatives;
- retain information where required by law or reasonably necessary to protect the Platform, resolve disputes or prevent fraud; and
- take any other reasonable steps necessary to administer the termination.
Termination of an account does not affect any rights or obligations that accrued before the date of termination.
14.5 Revenue Sharing and Membership Benefits
Unless otherwise provided under the applicable program rules, suspension or termination of an account may result in the loss of eligibility to participate in Revenue Sharing Programs, Premium Membership benefits or other Platform services.
Any payments accrued before termination will be dealt with in accordance with the applicable program rules and these Terms.
14.6 Reinstatement
Where an account has been suspended, PByT may restore access if the circumstances giving rise to the suspension have been satisfactorily resolved.
The reinstatement of an account is at the sole discretion of PByT and will depend on the nature of the original breach, the member's response and any ongoing risk to the Platform or its members.
14.7 Survival
Any provisions of these Terms that, by their nature, are intended to continue after suspension or termination—including provisions relating to intellectual property, privacy, limitation of liability, dispute resolution and any accrued payment obligations—will survive the termination of your account.
14.8 Review of Decisions
PByT recognises that, despite reasonable processes and safeguards, mistakes can occur.
If you believe that your account has been suspended, terminated or otherwise restricted in error, you may request that PByT review the decision by contacting us using the details provided in the Contact Information section.
PByT will consider each request in good faith, taking into account the information available, the nature of the alleged breach and any additional information provided by the member.
Following the review, PByT may confirm, vary or withdraw its original decision. The outcome of the review will be communicated to the member within a reasonable time, having regard to the complexity of the matter.
The review process is intended to promote fairness, accountability and the consistent application of these Terms. Nothing in this section limits PByT's ability to take immediate action where reasonably necessary to protect the Platform, its members or to comply with legal obligations.
15. Disclaimers
15.1 Platform Provided "As Available"
The Platform and its services are provided on an "as available" and "as is" basis.
While PByT endeavours to provide accurate, reliable and secure services, we do not guarantee that the Platform will always operate without interruption, error or delay, or that every feature will always be available.
15.2 Information and Opinions
The Platform enables members to publish questions, articles, comments and other content, and to participate in structured feedback.
Unless expressly stated otherwise, opinions, ratings, trust indicators, comments, survey results and other feedback published on the Platform represent the views of participating members and do not necessarily reflect the views of PByT.
PByT does not guarantee the accuracy, completeness or reliability of information contributed by members.
15.3 No Professional Advice
Content made available through the Platform, including feedback results, reports, analyses and other information, is provided for general information purposes only.
Nothing published on the Platform constitutes legal, financial, medical, investment or other professional advice.
Members should obtain appropriate independent advice before making decisions that may have legal, financial, health or other significant consequences.
15.4 Decisions Made by Members
Members are responsible for their own decisions and actions.
PByT is not responsible for any decision, action or omission made in reliance on information, feedback, ratings or other material available through the Platform.
15.5 Third-Party Content and Links
The Platform may include links to third-party websites, services or resources, or may display content provided by third parties.
PByT does not control, endorse or accept responsibility for third-party content, products or services, and access to them is at your own risk.
15.6 No Guarantee of Outcomes
PByT does not guarantee that participation in the Platform will result in increased reputation, business opportunities, income, audience growth, community support, successful fundraising, public influence or any other particular outcome.
Participation in the Platform is voluntary, and individual results will vary depending on many factors beyond the control of PByT.
15.7 Applicable Consumer Rights
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under applicable consumer protection legislation, including the Australian Consumer Law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, PByT will not be liable for any loss, damage, cost or expense arising from or relating to your access to, use of, or inability to use the Platform, except where such liability cannot lawfully be excluded.

You acknowledge that you are responsible for your own decisions and actions.
PByT provides a platform for participation and information sharing but does not guarantee the accuracy of member-generated content or the outcomes of any decision made in reliance upon information available through the Platform.
16.4 Third-Party Services
PByT is not responsible for the acts, omissions or failures of third-party service providers, including providers of payment processing, hosting, identity verification, communications, analytics or other services that support the operation of the Platform.
16.5 Security
PByT takes reasonable steps to protect the security of the Platform and the information entrusted to it.
However, no online service can guarantee complete protection against cyber attacks, unauthorised access, malicious software, data breaches or other security incidents.
Members are responsible for maintaining appropriate security over their own devices, passwords and account credentials.
16.6 Maximum Liability
Where PByT is found liable for any claim arising from these Terms or the use of the Platform, and where liability cannot lawfully be excluded, PByT's total liability will be limited to the maximum extent permitted by applicable law.
Where permitted by law, PByT may elect to:
- re-supply the relevant service;
- repair or replace the affected service; or
- refund the amount paid by the member for the relevant service during the applicable subscription period.
16.7 Consumer Rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded or limited under applicable legislation, including the Australian Consumer Law.
16.8 Reasonable Allocation of Risk
The limitations and exclusions contained in these Terms reflect a reasonable allocation of risk between PByT and its members.
These provisions are an essential basis upon which the Platform and its services are made available.
17. Changes to these Terms
17.1 Right to Update
PByT may amend these Terms from time to time to reflect changes in the Platform, applicable laws, technology, business operations, security requirements or other legitimate operational needs.
17.2 Notice of Changes
Where practicable, PByT will endeavour to provide reasonable notice of material changes before they take effect.
Notice may be provided through the Platform, by email, or by any other reasonable means of communication.
Minor administrative, editorial or legal updates that do not materially affect members' rights or obligations may take effect immediately.
17.3 Acceptance of Revised Terms
Your continued access to or use of the Platform after revised Terms become effective constitutes your acceptance of those revised Terms.
If you do not agree with the revised Terms, you must discontinue your use of the Platform and, where applicable, cancel any active subscriptions.
17.4 Existing Obligations
Unless expressly stated otherwise, amendments to these Terms do not affect rights or obligations that arose before the revised Terms came into effect.

18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You agree that the courts of New South Wales, and any courts competent to hear appeals from those courts, have non-exclusive jurisdiction in relation to any dispute arising out of or in connection with these Terms or your use of the Platform.
18.2 Good Faith Resolution
PByT believes that most disputes can be resolved through open communication and good faith discussion.
If a dispute arises in relation to these Terms or the use of the Platform, both you and PByT agree to make reasonable efforts to resolve the matter through direct communication before commencing legal proceedings, unless immediate legal action is reasonably necessary.
18.3 Escalation
If a dispute cannot be resolved through direct communication within a reasonable time, either party may pursue any legal rights or remedies available under applicable law.
Nothing in these Terms prevents either party from seeking urgent injunctive relief or other remedies where immediate action is reasonably necessary to protect legal rights, personal safety, confidential information or intellectual property.
18.4 Severability
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.
18.5 Waiver
A failure or delay by PByT to exercise any right or remedy under these Terms does not constitute a waiver of that right or remedy.

These Terms should be interpreted in a manner that gives effect to their purpose of supporting a trustworthy, transparent and constructive platform for public participation, while fairly balancing the rights, responsibilities and legitimate interests of both members and PByT.
Nothing in this section limits the operation of any applicable law or the authority of a court or tribunal to interpret these Terms in accordance with the law.
